All bookings for the trip are made with Untourist Escapes and are subject to the conditions (terms of use). By using the services or opting to travel on any trips organised by Untourist Escapes, you agree to the following conditions. The persons signing the booking form accept the conditions and are hereafter referred to as the “Travellers''.

Acceptance of terms

The services provided by Untourist Escapes are subject to the terms of use defined hereafter. Untourist Escapes organises travel packages to various locations. Untourist Escapes is specialised in organising group trips to offbeat destinations.

By accessing or using this site in any way – including using any services, downloading materials or browsing the site (services, materials, and site defined below) – you agree to and are bound by the terms and conditions set forth in this document.

Untourist Escapes has the sole discretion of changing from time to time, the terms of use and other guidelines/rules posted on the site. This website, the materials and services are made available by Untourist Escapes for your access and use, and are subject to the terms of use.

These terms and conditions are in place to ensure the safety, well-being, and overall comfort of all Travellers during the trip. Your understanding and cooperation with these rules is greatly appreciated.

Flights, visa and travel insurance

Unless otherwise specified in the travel itinerary or requested by the Traveller, the Traveller is responsible for arranging for flight tickets to the destination and back, visa for the destination country and travel insurance for the period of travel. Any denial of entry at immigration, and any additional cost arising out of alternate arrangements for deportation has to be borne by the travellers.

Untourist Escapes will not be responsible for the Traveller missing any flight or connecting flight or any other mode of transportation.

Untourist Escapes will provide documentation, if any, required for the purposes of obtaining a visa. However, Untourist Escapes will not apply for the Traveller’s visa or guarantee grant of the Traveller’s visa by any Embassy. The Traveller will be solely responsible for grant or rejection of its visa by any Embassy.

Travel insurance is mandatory for all Travellers traveling on any trip or independent itinerary arranged by us. Travellers are responsible for obtaining adequate insurance that covers expenses for the unexpected events mentioned in the liability paragraph. This includes coverage for the loss of baggage, medical expenses, helicopter (air or ground) rescue, injury, death, repatriation, cancellation, and curtailment of the itinerary.

Assumption of risks

Please understand that there are certain hazards involved in the trip that you must accept at your own risk. Untourist Escapes will not be liable for any illness, major or minor injury sustained, or death during the trip. Additionally, Untourist Escapes will not be liable for any loss of your property or other losses during the trip. Untourist Escapes shall not be held responsible for any accidents or unforeseen natural calamities. While every effort is made to ensure a safe and enjoyable travel experience, there may be factors beyond Untourist Escapes’ control. Travellers are advised to be aware of and accept these conditions when booking the trip. Your safety and well-being are of utmost importance.

Travel conditions
  1. Untourist Escapes reserves the right to change, cancel, amend or alter any trip or itinerary without notice and at its sole discretion.
  2. The Traveller agrees to provide Untourist Escapes, at the request of Untourist Escapes with all the documents such as any travel document, flight booking or any other document relevant to the travel.
  3. The Traveller is liable and responsible for any loss of personal belongings while travelling with Untourist Escapes. Untourist Escapes shall not be held responsible for any theft of personal belongings or personal belonging left behind on any trip irrespective of the circumstances.
  4. In case Traveller requires any special attention owing to any physical disability, the Traveller must inform the same to Untourist Escapes. Untourist Escapes will make reasonable attempts to accommodate the special requirements. Untourist Escapes is not responsible in the event it is unable to do so nor is it responsible for any denial of services by carriers, hotels, restaurants, or other independent suppliers.
  5. The Traveller is responsible to make arrangements for their own food as per Traveller’s dietary restrictions. Untourist Escapes shall not be responsible and cannot guarantee any special meal to the Traveller.
  6. The Traveller agrees to abide by the laws of the country the Traveller is traveling to. The Traveller agrees to comply with the rules and requirements of the hotels, hostels or any other accommodation organized by Untourist Escapes. Untourist Escapes will not be responsible for any infringement or violation of any law in any country by the Traveller.
  7. The travel information and services offered on the site are subject to restrictions and conditions. As a result of such restrictions and conditions, the price and itinerary of the trip may change without notice.
  8. The carriers and accommodations including but not limited to trains, cruises, ferries, hotels, and restaurants providing the services at the travel destination are available for booking are not run, supervised, or controlled in any way by Untourist Escapes. These services are provided by local operators or other third parties in the respective country that are entirely independent of Untourist Escapes. Untourist Escapes has no control and has no right of control over the operations of these independent contractors.
  9. Untourist Escapes may publish content of the Travellers on its website, social media platforms or in its marketing material. However, such content can be taken down upon request from the Travellers.
Cancellation and Refund

The cancellation terms vary on a trip-to-trip basis and are listed under each trip itinerary.

Untourist Escapes cannot be made liable for the consequences of weather conditions, flight cancellations, war or threat of civil war, strikes, pandemics, endemics, industrial action, political unrest, or any other force majeure, unusual or unforeseen circumstances. Untourist Escapes reserves the right to alter the itinerary in case of such events. Any additional expenses, such as extra hotel accommodation, flight or road transport will be on your charge and must be paid directly on the spot.

In the case of unforeseen weather conditions or other restrictions, certain planned activities during the trip may have to be rescheduled or cancelled. In such cases, we will try our best to provide an alternate feasible activity. However, no refund will be provided for the same.

In case the trip is cancelled due to unforeseen circumstances such as on account of a pandemic, civil disturbances, adverse weather conditions or any such event, be rest assured that we will work with all our trip partners such as hotels, guides and any other service providers to refund the maximum amount possible.

In case Untourist Escapes cancels the trip, due to any reasons not mentioned above, the full amount will be refunded to the Travellers.

Intellectual Property

All the Untourist Escapes materials and services including the itinerary, selection and arrangement, are the intellectual property of Untourist Escapes including but not limited to copyrights, trademarks, patents, trade secrets, and all other intellectual property and proprietary rights (intellectual property rights). Any unauthorized use of the materials or services may violate such laws and the terms of use. Unless expressly provided herein, Untourist Escapes does not grant any express or implied rights to use the materials and services. It is deemed admitted that you agree not to copy, republish, frame, download, transmit, modify, adapt, create derivative works based on, rent, lease, loan, sell, assign, distribute, display, perform, license, sublicense or reverse engineer the site, materials or services, any portions of the site, materials or services or the selection and arrangement of the site, materials or services, except as expressly authorized.

Personal Information and Privacy

Untourist Escapes may use and protect your data, such as your name and address, in accordance with the Privacy Policy.

Term and Termination

The user agrees to remain bound by the terms of use (as amended from time to time) for as long as they remain a user of the site and wishes to use the site unless Untourist Escapes earlier terminates, suspends, or otherwise limits access to the site in accordance with these terms of use or otherwise deems appropriate at its sole discretion.

Indemnity

You agree to indemnify, defend and hold harmless Untourist Escapes and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these terms of use or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Limitation of Liability

In no case shall Untourist Escapes, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of our services, or for any other claim related in any way to your use of our services, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via our services, even if advised of their possibility.

Severability

In the event that any provision of these terms and conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these terms of use, such determination shall not affect the validity and enforceability of any other remaining provisions.

Entire Agreement

The failure of us to exercise or enforce any right or provision of these terms of use shall not constitute a waiver of such right or provision.

These terms and any policies or operating rules posted by us on this site or in respect to the services constitutes the entire agreement and understanding between you and us and governs your use of the services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the terms of use).

Any ambiguities in the interpretation of these terms of use shall not be construed against the drafting party.

Governing Law

These terms and conditions and any separate agreements whereby we provide you our services shall be governed by and construed in accordance with the laws of India and the courts at Navi Mumbai shall have the exclusive jurisdiction of any disputes or claims.
